These Terms govern your access to and use of DuckColor (the ?Service?). DuckColor provides AI-generated color palettes, palette browsing, a color library, and learning content (e.g., blog and quizzes). By using the Service, you agree to these Terms and our Privacy Policy (/privacy).
Acceptance
If you do not agree to these Terms, do not use the Service. You represent that you have the legal capacity to enter into these Terms; if you are under the age of majority, you may use the Service only with a parent or guardian's consent.
Accounts and access
Some features are available without signing in. If you sign in, we may use third-party authentication providers (for example, Google). You are responsible for safeguarding access to your account and device, and for all activity that occurs under your account. To keep the Service reliable and fair, we may apply usage limits (such as rate limits or daily quotas) and may change those limits at any time. We may restrict, suspend, or terminate access if we detect abuse, suspicious activity, or violations of these Terms.
Acceptable use and content guidelines
You agree to use the Service only for lawful purposes and in compliance with applicable laws. You must not: (a) bypass quotas, access controls, or security measures; (b) excessively scrape or stress the Service via automation; (c) upload, input, or generate illegal, infringing, deceptive, harassing, hateful, violent, or sexually explicit content; (d) distribute malware or attempt to probe/attack our systems; or (e) impersonate others or mislead third parties. You are responsible for your prompts, parameters, and how you use the generated results. Before using results in products or commercial work, you should review and test them (e.g., readability, contrast/accessibility, and compliance).
Intellectual property and generated results
The Service (including code, UI, branding, and documentation) is owned by DuckColor or its licensors and is protected by intellectual property laws. You retain rights to the content you provide (such as prompts). For outputs generated by the Service (including color values, palette names/descriptions, and exported images), we grant you a non-exclusive license to use them in personal or commercial projects, subject to these Terms. Outputs may be similar to others' results and may be impacted by third-party rights. You are responsible for ensuring your use does not infringe any third-party rights.
Service availability and disclaimers
We strive to provide a stable and secure Service, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time (including tools, generation behavior, quota rules, or learning content). The Service and outputs are provided ?as is? without warranties of any kind. Outputs are suggestions only and are not a substitute for professional judgment. You assume all risks arising from your use of the Service and outputs.
Limitation of liability
To the maximum extent permitted by law, DuckColor and its affiliates, employees, and partners will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of (or inability to use) the Service, including loss of profits, data, or goodwill. Where liability cannot be fully excluded, these limitations apply to the fullest extent permitted by law.
Changes to Terms
We may update these Terms from time to time and will update the ?Last updated? date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
